charging costs for electric, plug-in hybrid or hydrogen-powered vehicles, incurred by employees for journeys between their usual place of residence and their place of work.

In principle, it is reserved for employees who are obliged to use their own vehicle, that is to say :

Those whose usual place of residence or place of work is situated in a municipality not served by a regular public transport service (or by a private service organised by the employer), or outside the scope of a mandatory mobility plan;

Or those whose working hours do not allow them to SCXW226221573 BCX0">What the decrees of 20 October 2026 change

The two decrees of 20 October 2026 (Nos. 2026-973 and 2026-974) provided a regulatory basis for raising the ceiling, which had previously only been announced.

Consequently, the ceiling for exemption from social security contributions has been raised to €1,000 per year per employee for sums paid up to 31 December 2026.

Two important points to note :

The sum of €1,000 is a maximum, not an amount that must be paid: the allowance remains optional and each employer may decide to pay all or part of this sum.

This ceiling applies to both the fuel (or electric charging) allowance and the sustainable mobility allowance. For example, an employee who already receives a sustainable mobility allowance of €400 will only be eligible for a tax-exempt fuel allowance of €600.

Which employees are affected ?

The two decrees do not address the conditions for awarding the allowance. Nevertheless, the BOSS has clarified these conditions with regard to fuel costs.

Thus, for fuel costs alone and until 31 December 2026, a relaxation of the rules has taken place in two stages :

Since the press release of 6 August 2026 : the allowance may be paid even if the employee has access to public transport, and may be combined with the reimbursement of the cost of a public transport season ticket;

Since the press release of 22 October 2026, published following the decrees : it appears that the remaining conditions have also been lifted: the allowance could be paid regardless of the employee’s working hours or whether they are subject to a compulsory mobility scheme.

According to this interpretation, any employee who uses their own vehicle for their commute could therefore benefit from this. That said, and as highlighted by the BOSS, this relaxation will need to be confirmed by the 2027 Finance Act.

Please note : this relaxation does not apply to the recharging of electric vehicles or the sustainable mobility allowance, which remain subject to the usual conditions. It must also be enshrined in the 2027 Finance Act, which is currently under review.

How is this treated for tax purposes for the employee ?

The decrees of 20 October 2026 relate solely to the exemption from social security contributions.
