The publication of Decree No. 2025-840 of August 22, 2025 strengthens the protection of information relating to the domicile of certain natural persons listed in the trade and companies register.
This new text allows the personal addresses of natural persons who are managers and partners with unlimited liability in companies listed in the trade and companies register to be concealed indefinitely.
The following persons may request that their personal address be concealed :
- Managers, chairpersons, chief executive officers, deputy chief executive officers
- Members of the executive board, chairperson of the executive board or, where applicable, sole chief executive officer
- Partners and third parties with the power to habitually direct, manage, or commit the company, with an indication, for each of them in the case of a commercial company, that they commit the company alone or jointly with others vis-à-vis third parties
- Directors, chairpersons of the board of directors, chairpersons of the supervisory board, members of the supervisory board, and auditors
- Permanent representatives of legal entities appointed as directors
- Representatives in France and abroad of branches of foreign companies
This confidentiality applies to the company’s actions (past and present), as well as the company’s KBIS extract (*)
The confidentiality request is made via the one-stop shop for business formalities, either :
- Independently of any formalities with the Trade and Companies Register
- Or during registration, modification, or deregistration
From now on, information relating to the personal address of the director will only be accessible to certain authorities, administrations, and regulated professions, which are exhaustively listed.
This measure, which aims to strengthen the protection of company directors’ personal data, and in particular the confidentiality of their personal address, marks a significant step forward in protecting the privacy of directors, while maintaining a balance with the requirements of economic transparency.
In order to ensure that you benefit from this protection under the best possible conditions, the legal department is at your disposal to submit the confidentiality request and follow up on the procedure with the court registries.
